"The DOL's Wage and Hour Division clarified that participation in a clinical trial can qualify as 'treatment' under
the FMLA if it involves an employee's own serious health condition and all other FMLA eligibility requirements are met. The Wage and Hour Division, acknowledging the experimental nature of some clinical trials, emphasized that the FMLA regulations' definition of 'continuing treatment' does not require that a clinical trial meet a certain level of efficacy or achieve specific results." Post-Tax Reimbursement of Premiums for Employee Covered Under Spouse's Plan
"We currently cover 100% of the insurance premiums for our group health plan for individuals and families. We would like to reimburse the out-of-pocket cost of the group medical insurance premium cost, for an employee and their family, if they should choose to stay or move to the
spouse's employer's group medical insurance program. We would make the reimbursements on a post-tax basis. Our thought is that this would not create a plan under current regulations. Are there an ACA issues with reimbursing employees in this manner?"
