Supreme Court to Hear Retired Firefighter's Bid to Sue Ex-Employer Over Benefits

"In her brief on the merits, Stanley pushes back against the 11th Circuit's contention that she cannot sue because she did not work for the city when her retirement benefits were ended. The ADA, she insists, sweeps broadly to allow lawsuits by 'any person alleging discrimination' in violation of the act who 'claims to be aggrieved.... The Biden administration filed a 'friend of the court' brief supporting Stanley in which it ... contends the ADA also prohibits discrimination in benefits provided to former employees." [Stanley v. City of Sanford, Florida, No. 22-10002 (11th Cir. Oct. 11, 2023; cert. pet granted No. 23-997, Jun. 24, 2024)]  MORE >>

Did You Work for Federal, State or Local Government? Check Your Social Security Benefits

"[As] a result of the new law, workers impacted by these WEP and GPO offsets will be eligible for retroactive benefits from 2024 and all future benefits in 2025 and beyond. Given the significance of these changes, those who worked for the government at some point in their career are encouraged to revisit their current retirement planning strategies and make the appropriate adjustments. ... [T]hese higher payments will also increase funding pressure on the Social Security Trust Fund that provides support for current and future retirees."  MORE >>

Strong Strategic Plans Are the Foundation for Good Governance

"Public pension funds are complex organizations that ensure financial security for millions of retired public sector employees and require careful management and oversight to remain effective and sustainable.... PS Non-Elective Allocation, All Employees Are HCE

"Is this correct: If a business has all HCE employees (each earning well in excess of the HCE compensation limit... in fact in excess of the 401(a)(17) limit), when it comes to allocating a PS NEC contribution, can the allocation be discriminatory? Can the owner of the business max out himself and contribute zilch to everyone else? Even pick and choose who might get a NEC contribution? Seems to be passing the tests when I run them all. I've never had this kind of a situation. If all good, I'm pleasantly surprised (and so will the business owner be)."
