Presidential Memorandum Directs DOL to Issue ERISA Guidance on ‘Foreign Adversary’ Investments

"While the memorandum's scope extends beyond ERISA plans, one stated goal is restoring the 'highest fiduciary standards' under ERISA 'to ensure that foreign adversary companies are ineligible for pension plan contributions.' ... To further this goal, the memorandum instructs DOL to publish updated ERISA fiduciary standards for investments in these companies. The memorandum doesn't set a deadline for this guidance, so when DOL may act on this directive remains uncertain."  MORE >>

Second Circuit Revives IBM Retirees' Pension Lawsuit

"The class action lawsuit filed by IBM retirees who alleged they were shorted on pension payments has been revived by a federal appeals court.... Fiduciary Liability Insurance Pricing Driven by Plan Governance and Investment Fees

"About 80% of insurance companies surveyed said conducting periodic plan administration fee benchmarking reviews conducted by a plan's investment committee makes a significant impact on the pricing of fiduciary liability insurance. "Our Pension reporting system (filing 5500 etc) is having technical issues. Until we resolve the issues: [1] Are there alternate methods that we can use to file a few 5500s? [2] Does I-file work similar to as when we file as third party signs and files for the client from our regular reporting program? [3] And is it easy to register and get started to use I-file? [4] Are there any other alternatives that we can use to get these 3 or 4 Forms 5500 filed?"
