[Official Guidance]
Text of PBGC Proposed Technical Amendments to Special Financial Assistance Regs
18 pages. "The [PBGC] is proposing technical corrections, clarifications, and improvements to the restrictions and conditions in its regulation on special financial assistance. These changes would clarify (a) the permissibility of investing special financial assistance in certain
securities and (b) the condition requiring PBGC approval for settling withdrawal liability claims. The amendments also would repeal a provision that enabled plans that received special financial assistance to request the reallocation of employer contributions to pay for health benefit costs." DOL Proposes ERISA Safe Harbor for Selection of 401(k) Investment Options
"A central theme of the proposed rules is that ERISA's prudence standard focuses on the fiduciary's decision-making
process and requires an objective evaluation of relevant factors at the time an investment decision is made, rather than judging the decision based on subsequent investment performance. The proposed rules also state that fiduciaries who satisfy the safe harbor should receive substantial deference regarding their investment decisions." MORE >>

Automatic Enrollment Arrangements and Changes of Heart
"Most automatic enrollment plans do not currently allow participants to change their mind and receive their deferrals back within a set timeframe - but that may be changing as new plans are now mandated to have such a provision." MORE >>

Fixed Income, TDFs, Among Top Innovations for DC Plan Sponsors
"[O]ver half of institutional consultants expect most clients to incorporate active non-core fixed income options and 45% predict their clients will adopt multi-asset inflation hedging strategies, as more look to safeguard savings in an uncertain market.... A high number of
consultants and advisors expect clients to consider blended target-date funds (TDFs) as a new default strategy ... Close to half (46%) of aggregator firms believe they'll see more clients adopt fully customized TDFs, while 85% consider participant-personalized TDFs as 'next-generation defaults.' " MORE >>

Treasury Announces Access to Trump Accounts for Foster Children
"[A] child welfare agency of a state, territorial, or tribal government that is the legal guardian of an eligible child who has a Social Security number and does not already have an account may elect to open an initial Trump Account for that child.... States are strongly encouraged to adopt policies that explicitly authorize child welfare agencies, or their designees, to act on behalf of children in their care in establishing and managing these accounts." Setting a Retirement Savings Plan for DINKs
"DINKS (dual income, no kids) have no adult children on the horizon to help with trips to the doctor, meal deliveries, or activities of daily living as needed. Thus, the surviving spouse is potentially more likely to have to pay out of pocket for support services as they age.
Similarly, seniors with no immediate family to provide room and board during their twilight years may move into an assisted living facility or nursing home sooner than their peers who are parents. Paying those bills for even a few extra months can take its toll on their budget." MORE >>

Experience Studies Can Reduce Corporate Pension Plan Cost Volatility
"Regular reassessment of a corporate pension plan's assumptions keeps them aligned with evolving demographic and economic realities. An experience study enables plan sponsors and their actuaries to identify needed adjustments to better manage cost volatility and secure the
plan's long-term financial health." MORE >>

Defined Benefit Plan Trends, Assumptions, and Computations
"[A]ccountants can track the factors that impact the net value of pension liabilities.... [E]mployers should be aware of and assess the viability of continuing to offer DB pension plans.... [P]rofessionals should consider the types and terms of DC plans as a component of the
overall benefits offered to employees to determine their feasibility. Lastly, while recent trends in stock market returns and interest rates have helped reduce the financial pressures on pension plans, these trends (not to mention global trade and health crises) can reverse quickly." MORE >>

SEC Proposes Filer Status Changes with Significant Executive Compensation Disclosure Implications
"[SEC Release No. 33-11419] would significantly revise the public company filer status framework and related disclosure
obligations. While the proposal is not limited to executive compensation, one of its most notable effects would be to expand the availability of scaled disclosure requirements that could substantially reduce disclosure of executive and director compensation for many U.S. public companies. If adopted as proposed, the amendments could become effective as early as the 2027 proxy season." MORE >>

Leased Employees- Partial Plan Termination
"We have a plan with about 1000 active employees. About 300 were moved to a leasing corporation in 2025. The plan excludes leased employees. Would this be considered a partial plan termination?"
