    The Form 5500 instructions support BG5150's thought. Schedule C (Service Provider Information) – is required for a large plan, MTIA, 103-12 IE, or GIA if (1) any service provider who rendered services to the plan or DFE during the plan or DFE year received $5,000 or more in compensation, directly or indirectly from the plan or DFE, or (2) an accountant and/or enrolled actuary has been terminated.

  3. There are also other factors which will determine whether or not an audit of the Form 5500 is necessary, including 80-120 particpant rule and small plan audit requirements.

  5. Are you asking when it is necessary for a plan to have an annual examination and report by an independent qualified public accountant (IQPA) or are you referring to some other type of information audit?

  9. There are minimum vesting requirements that apply to a top-heavy plan. All contributions must vest at least as quickly as under a three-year cliff schedule or alternatviely under a six-year graduated vesting schedule. (20% after 2 years of service, 100% after 6.)
  10. The penalty amount is $10 per day after filing deadline up to $750 maximum. Since, by my count, the filing is more than 75 days past due, the penalty should be $750.

Sorry, Noodle, I think that you are right that that only applies for a rollover to another plan, not IRA. §1.402A-2 Reporting and recordkeeping requirements with respect to designated Roth accounts. Q-2. In the case of an eligible rollover distribution from a designated Roth account, what additional information must be provided with respect to such distribution? A-2. (a) Pursuant to section 6047(f), if an amount is distributed from a designated Roth account, the plan administrator or other responsible party with respect to the plan must provide a statement as described below in the following situations-- (1) In the case of a direct rollover of a distribution from a designated Roth account under a plan to a designated Roth account under another plan, the plan administrator or other responsible party must provide to the plan administrator or responsible party of the recipient plan either a statement indicating the first year of the 5 -taxable-year period described in A-1 of this section and the portion of the distribution that is attributable to investment in the contract under section 72, or a statement that the distribution is a qualified distribution. (emphasis added)
  13. I think that in the case of a direct rollover of a non-qualified Roth 401(k) distribution a notice is provided to the Roth IRA specifying what portion of the distribution represents the participant's basis and the year of the participant's first Roth contribution to the plan.
