  1. In the Relius Gov't Forms software, if you go to Edit>Attachments. You add them there to the specific line item.
  2. Not sure why but I see finished and Efile even with the Enable filing on. I haven't experienced the problem with the signature being rejected - do you have the latest service packs for the software? I am not sure what else it could be. Are they entering the pin twice and their name is in the name box, right? I have submitted many plans and mine all sign Filing Received. I have another question, for some of my plans which don't have attachments I still see the paperclip on the side. If I click on it, it states nothings attached. Not sure why it shows on some plans but not on others - have you experienced that? Thanks for your help.
  3. In regards to filing 5330s for late 401k deposit. In 2008 the plan had a late 401k deposit of about 500. It was discovered in 2009 so the earnings were calculated (about $35) and deposited as earnings in the 2009 plan year. The Form 5330 was done with the 2008 5500 ($12 penalty). For 2009 we have to report the late deposit again on the 5500 b/c it was corrected in 2009, but I have also read that I have to do another form 5330 - is that correct? What amounts do I put on the 5330? Any help would be appreciated. Thanks.
  4. Sometimes when I hit save in a plan it give the error that the plan has already been electonically signed when we have not even published the plan yet? Does anyone else have that issue? This is in the Relius Govt Forms software - not in web client.
  5. We have our clients sign and save their signatures, then we will efile the return. After signing the 5500 with the credentials, the systems states Signatures Saved. We then click EFile and send the return. When and why would we use the "finish" button in the action grid? If a client signs the return and saves, then clicks finished, we cannot efile, we have to republish then efile. Any ideas?
  6. Do you agree then that the Max amount they can contribute is 25%?
  7. We have a Davis Bacon Prevailing Wage Plan we administer. In the past the plan sponsor has contributed 25% of wages (non-elective) into the plan. The plan has immediate eligibility and 100% immediate vesting. Someone has told The Plan sponsor they can further increase their contributions above 25% to take further advantage of FICA savings and lower workers comp. We were under the belief that these plans must comply with ERISA and 404c deduction limits. Since these are employer contributions and not employee deferrals the deductibility limit should be capped at 25% ? Any thoughts?

  9. Is there a limit to the number of hardships a person can take within a plan year or within 12 months. The plans document does not specify any hardship limits except to only take from deferrals. The participant in question took a hardship in Sept 2009 and is requesting another to prevent forecloure. Thanks.
  10. I have a plan that lays off employees during the winter. When the employee comes back we refinance their loan to be sure the finish the loan in the original time period. One participant came back and made a few loan payment but his loan need to be paid up by 6/1. He still has a $500 balance. He needs to pay off in full now or the loan defaults correct? It is a deemed distribution not an offset correct since he has not had a distributable event? This also limits him to not being able to take a new loan in the future right? Also, I have a plan that stopped making payments on a participants loan b/c the participant could not afford to make the payments anymore. The plan just told us they did this months ago. The loan is in default now. Is this also a deemed distribution since the participant still works there?

  13. If a participant is taking a distribution from a 401k plan and the plan does require spousal consent but the balance is under $5000.00 does the participant have to get a spousal consent?
