  1. This is from the IRS instructions: Line B - Box for First Return/Report. top Check this box if an annual return/report has not been previously filed for this plan. For the purpose of completing this box, the Form 5500-EZ is not considered an annual return/report. Mike
  2. Here is mine you can try where D1 is the compensation and E! is the deferral: =IF(E1/D1<0.04,E1/D1*D1,IF(E1/D1<0.07,(((E1/D1-0.04)*0.333333333+0.04)*D1),0.05*D1)) It is from a few years ago and may be more complicated then is has to be. Mike
  3. My father used to tell me this story all the time. Love it. The only difference is that he said the bellhop kept the $2 because he felt he was underpaid! Thanks for posting it! Mike
  4. Here is 2011 Gray Book Question 7. Mike 2011 Gray Book Q & A 7.pdf
  5. We have been using Datair for many years and are happy with the system as well as the service we receive. It works well for us in the small plan world. Mike
  6. Agree. Also IRS instructions say "Generally use Code 7 if no other code applies". Mike
  7. Yes but their $100 million software package is only as accurate as the ability of the person who does the input! Happy New Year to all!! Mike
  8. We like to get the SSA's that were filed for 2 reasons. The first is to make sure the proper participants were reported. The second is to remove participants who were reported and have been paid their benefit. This prevents participants from getting the letter from the SSA saying they "may" have a benefit due. Mjke
  9. But if the plan was a safe harbor to NHCEs only, since that participant is NHCE, he/she gets the safe harbor and ADP test not a problem. Otherwise, what Lou S. said. Mike
  10. Where (and when) is this from? It seems to be the opposite of what was said in Private Letter Ruling 201229012. Mike
  11. This is one of my concerns too. You could have 2 participants (One HCE and the other NHCE) each with 2 years vesting service. HCE is 100% vested, NHCE is 0% vested. I think that is what OP was getting at. Mike
  12. Doesn't the plan also have to allow participants to make catch-up contribution? Mike
  13. Probably the broker! Mike
  14. All the plans I draft automatically exclude Red Sox fans!! Although, I di root for them in the world series....of 1967. Mike
  15. I would leave it in forfeiture account. If document says reduce and contribution is $0, you can't reduce it. Mike
  16. Here are the IRS Form 1040 instructions: line 7 Excess salary deferrals. The amount deferred should be shown in box 12 of your Form W-2, and the "Re-tirement plan" box in box 13 should be checked. If the total amount you (or your spouse if filing jointly) deferred for 2016 under all plans was more than $18,000 (excluding catch-up contribu-tions as explained later), include the ex-cess on line 7. So, I would think if you input items accurately, the software would determine any excess deferral. Mike
  17. Same here. Have not filed for a DT in many years. Mike
  18. More like the 10/15 deadline!
  19. We are a small firm, 7 employees (3 pension administrators, 3 support staff and 1 owner). Basically, each administrator does everything on their cases. Support staff doe prepare and follow up on census data, prepares 1099's and does payroll processing of deposits. We are not large enough to allocate staff to one or two particular items. Years ago during one of the document restatement periods (another company), the head of my "team" split us up and had 2 people doing valuations, 2 doing documents and 2 doing plan terms and benefits. It did work well mainly because the two weakest individuals were assigned the benefits and plan term work. I don't like that approach and what we are doing works well for us. Mike
  20. No, Nickel Beer Day was held without incident in Cleveland in 1971.
  21. What about "Ten Cent Beer Night" sponsored by the Cleveland Indians, June 4, 1974?
  22. I just had this same situation. A client was not sure if he filed the form 5500-EZ for the 2016 plan year. I called the IRS help number (877) 829-5500 and within 5 minutes I was told a filing was received. The person I spoke with was very helpful. Had to provide information from the form (name, address, EIN). Mike
  23. 1 - About 95% of the time 2 - About 5% of the time Mike
  24. We use Datair for our valuation system and are very happy with it. Most of our plans are small, under 100 participants. We administer DB, DC, 401(k) and ESOP plans. Like you, we use FT Williams for 5500 and documents. Mike
