  2. I had a question on RMDs that I am getting confused with. If a participant over Age 70.5 (Age 76) terminates employment in April of 2018, would their first RMD be due April 2019 or December 2018?
  3. We had a company acquire another in 2018 and they both maintain separate plans. They now are a control group. The one that acquired the other utilizes top-paid group while the other plan does not. I know we are supposed to be uniform in how these are tested but wasn't sure if it's okay to test separately during the acquisition year.
  4. That's what I was thinking. Maybe amend Plan for 2019 to allow her in Plan and return her 401(k) for 2018. Would also think some employees would be subject to Top Heavy Minimum if Owner is receiving Profit Sharing and Plan is Top Heavy as you have indicated.
  5. Does Plan Document allow everyone to be eligible upon effective date or did she work 1000 hours in the Past to become eligible to defer 401(k)?

  7. We had a participant that was upset their Plan didn't allow for their ROTH IRA to be rolled over to their Retirement Plan. They had a ROTH 401(k) and didn't reply when their Plan was terminating and was rolled over to a ROTH IRA. I was wondering if this was an IRS Rule or something that can be allowed.
