Guest jes Posted March 22, 1999 Posted March 22, 1999 Can an insurer terminate an employee's health insurance if the employee lied about prior medical conditions on the initial application? Does HIPAA prevent this?
Guest JRedding Posted March 22, 1999 Posted March 22, 1999 HIPAA does not address the issue of fraud --which is what this is. I would think that the carrier is quite reasonable in terminating coverage for this person. The only issue HIPAA addresses is that a person cannot be turned down for health reasons. The carrier is not doing it for those reasons but for the fact that the ee lied on his original application.
