If you are an employee or plan participant the SPD can be handed to you, faxed to you, emailed to you or mailed to you. The addressing on the medium chosen for distribution can have your name plus any other valid address that ensures delivery to you. George D. Guest Keith371 Posted April 8, 2002 Posted April 8, 2002 I AM THE EMPLOYER, AND WAS TOLD BY MY PLAN SPONSOR THAT A PHYSICAL ADDRESS HAD TO APPEAR INSTEAD OF THE POST OFFICE BOX. THE ADMINSTRATOR'S CLAIMS WERE THE PARTICIPANTS AND BENEFICIARIES NEEDED TO HAVE THE STREET ADDRESS IN CASE ANY PROBLEMS AROSE. THERE HAS BEEN A P.O BOX SINCE THE PLAN'S INCEPTION. IS THERE SOME NEW LAW THAT REQUIRES A STREET ADDRES?
KJohnson Posted April 8, 2002 Posted April 8, 2002 Here is what the regs state: Plan Administrator--"business address" Trustee--"address of the principal place of bunsiness" Agent for Service--"the address at which process may be served". I have always put in the street address. However, my read on the regs is that for the Plan Administrator you can probably get by with the P.O. Box; for Trustee it is more doubtful since the P.O. Box is nto the principal place of business; and for the Agent for Process, I think you would need a street address because you cannot personally serve papers at a P.O. Box.

Howver, The SPD must also give the name of person designated as agent for the service of process on the plan and the address at which process may be served on such person. mjb
