MBCarey Posted July 10, 2002 Posted July 10, 2002 A while back I remember the DOL issuing guidance on fees that could be deducted from participant accounts and fees that could not. Can anyone tell me how and where to find this?
Guest LWilson Posted July 11, 2002 Posted July 11, 2002 If you have access to the recent ERISA Outline Book, there is an appendix outlining the expenses that may and may not be paid through plan assets. It appears most items on this checklist reference DOL and ERISA, so you may be able to find a checklist by referencing the DOL website. Is there a specific expense you were concerned about?
MBCarey Posted July 11, 2002 Author Posted July 11, 2002 We have a client who would like for the document restatement charges to be paid from participant accounts? Marybeth
Guest LWilson Posted July 11, 2002 Posted July 11, 2002 Good news for the sponsor: When a sponsor amends the Plan to reflect law changes affecting the Plan Document, it is permissable to charge the Plan. It is also permissable to charge the Plan for the Determination Letter when amending for changes in the law. There is a reference to PWBA Advisory Opinion 2001-01A on the checklist. You may be able to get quotable information from there.
