Therefore, between the two plans the participant's deferral would be limited to $12,000 (for 2003). In addition, when processing ADP/ACP tests, the contributions of HCEs are aggregated and used in testing for both plans. Why would the employer want the expense of two plans with no extra benefit? That is the whole reason they went to the PEO in the first place - they did not want to deal with these issues in-house - right?
