Guest BCoffey Posted April 18, 2003 Posted April 18, 2003 I am filing Form 5500 for a single employer 401(k) plan with only 4 employees. The instructions state to file Schedule T if the plan "is intended to be qualified under Code section 401(a) or 403(a)". Would a 401(k) plan automatically be qualifying under the above named sections? Or is it qualifying under section 401(k)?
Guest F1fan Posted April 18, 2003 Posted April 18, 2003 A 401(k) “plan” is actually a feature of plan that is intended to be qualified under Internal Revenue Code section 401(a). That remains true even if the plan consists only of 401(k) contributions made by the participants.
R. Butler Posted April 21, 2003 Posted April 21, 2003 I haven't looked at the 2002 5500, but in past years the instructions had a nice little chart telling you when to file the schedule. It listed the Schedules down the side and plan types up top. Generally you will file a Schedule T, unless you are filing for a welfare plan, a DFE, or a fringe benefit plan.
Brian Gallagher Posted April 21, 2003 Posted April 21, 2003 Hopefully, the plan is on a prototype, and it doesn't exclude any employess (other that the stautorial excludable ones). f that's the case, the T is merely just checking off a box. Remember: two wrongs don't make a right, but three rights make a left.
