Since the Safe Harbor requirements are to make sure that the NON highly compensated employees receive their required minimum, I can't see that there would be any violation of the law. HC are NOT required by law to receive a safe harbor nonelective. And if the document contains language permitting such a waiver, then you should be all set. But if it doesn't, then you are stuck.
