jkharvey Posted November 12, 2003 Posted November 12, 2003 401(k) Plan has 3% nonelective safe harbor contribution provision. Document is Corbel prototype language. I don't know why the ER has done this, but they are not making elective deferrals. Are we required to make the 3% safe harbor contribution?
Blinky the 3-eyed Fish Posted November 12, 2003 Posted November 12, 2003 Does your document only trigger the safe harbor nonelective if the a notice is given? If no, then yes, you must follow the document. If yes, see the next question. Did you give the notice? If yes, then the safe harbor nonelective must be given. "What's in the big salad?" "Big lettuce, big carrots, tomatoes like volleyballs."
Brian Gallagher Posted November 12, 2003 Posted November 12, 2003 The SH non-elective goes to all eligible participants, the SH match goes to only those deferring. Remember: two wrongs don't make a right, but three rights make a left.
Earl Posted November 13, 2003 Posted November 13, 2003 did you use the maybe notice? if so, 12/1 say no CBW
