Guest hardluckkid Posted February 4, 2004 Posted February 4, 2004 my company has to deposit my 401k contributions into the account. The money was deducted from my paycheck, but is not showing up in my 401k online account. My company has been evading phone calls concerning this. I checked with another employee and her contributions aren't showing up in her account either. Just wondering how much time my company has! The deductions from December aren't in there yet!!!
Brian Gallagher Posted February 4, 2004 Posted February 4, 2004 The absolute LATEST a plan has is the 15th business day of the month following the month in which the deduction was made. In this case, Jan 21. But the company has do do it as soon as administratively feasible so it should have been in there well before that. Did you try calling the record-keeper? Maybe your on-line account wasn't updated yet, but your account with them is. Maybe for some reason your true account isn't filtering over to the on-line system (just a thought). Remember: two wrongs don't make a right, but three rights make a left.
E as in ERISA Posted February 4, 2004 Posted February 4, 2004 The money has to be in the trust by the 15th day. However, it may be deposited in a general account of the plan. It may not be invested and show up on participant records until a later date. In many cases that occurs simultaneously with a delayed payroll or within a few days of a concurrent payroll. Longer time periods may be unusual, but are not necessarily a violation of the 15 day rule.
mbozek Posted February 5, 2004 Posted February 5, 2004 Call the local Employee Benefit Security administraton listed in the phone book under US Dept of labor. The fact the that your employer is not returning calls is a sign that there is something wrong. If the money has been transferred to the trustee or record keeper, then the employer would not delay in letting you know. You can also retain counsel although it will cost you money. By the way what business is your employer in? mjb
