billfgrady Posted April 1, 2004 Posted April 1, 2004 Outside of plan language prohibiting other employers from adopting the plan sponsor's plan, is there anything else that you can think of that could prohibit an employer unrelated to the plan sponsor from adopting its plan? Obviously, the companies would be in agreement that this could happen.
Guest JimD Posted April 2, 2004 Posted April 2, 2004 You can draft a plan that allows unrelated employers to participate in the same plan. Its called a multiple employer plan and its an individually designed plan. You cannot do this using a prototype plan. You have to test each employer separately and file a 5500 as a multiple employer plan. I'm not sure what your question is but maybe this helps.
