FundeK Posted July 27, 2004 Posted July 27, 2004 Is there a place you can search to find lawsuits by plan participants against a fiduciary or plan sponsor that have been settled? In particular, a participant who claims his distribution was delayed causing him a loss due to market fluctuation?
mbozek Posted July 27, 2004 Posted July 27, 2004 Cases that are settled are dismissed by the fed ct. The settlment is a private agreement that is not part of the ct record and the claimant agrees not divulge the terms of the settlement. The claimant merely files a stipulation of discontinuance with the ct. This is done precisely to prevent other parties from finding out what is paid to a claimant. mjb
