Guest qualified plan Posted September 22, 2004 Posted September 22, 2004 If an employer is establishing an EAP, would you be concerned if the EAP offers "Financial Advice," on the grounds that Financial Advice may include "advice" relating to investing in the employer's 401(k) plan? Would you think it reasonable to exclude such advice under the EAP? Thanks in advance for your thoughts.

mbozek Posted September 23, 2004 Posted September 23, 2004 Employer provided financial advice could be considered a taxable benefit to the employee for the fmv of the service. Retirement planning services is a tax free fringe benefit under IRC 132(m) if provided on a nondiscriminatory basis. mjb

Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
