Guest mpark Posted November 24, 2004 Posted November 24, 2004 Plan participant in a k plan wants to take inservice withdrawal of entire account balance and roll it to IRA. He is 72 years old. Plan has in service withdrawal provisions. Do the 70 1/2 MRD distributions kick in for this distribution?
Belgarath Posted November 24, 2004 Posted November 24, 2004 Assuming he isn't a "5-percent owner" then no. He hasn't reached his required beginning date under 1.401(a)(9)-2.
WDIK Posted November 24, 2004 Posted November 24, 2004 But then wouldn't the IRA be required to make a minimun distribution? ...but then again, What Do I Know?
WDIK Posted November 24, 2004 Posted November 24, 2004 The answer to my question is found in Ltr Rul 200123070. The IRS ruled that a non 5% owner employee who rolloed over a distribution to an IRA after attaining age 70-1/2 but before retirement could delay the first RMD from the IRA until the year following the year of the rollover. ...but then again, What Do I Know?
