Guest cstrong Posted June 9, 2005 Posted June 9, 2005 Does a participant have to be able to revoke a deferral election within a certain period of time? For example, if a plan's enty dates are semi-annually (Jan & July), can we make a participant wait until July to revoke an election? I have searched the regs and the best I can find is that a plan can't lock in a participant's election but are semi-annual entry dates sufficient?
Tom Poje Posted June 10, 2005 Posted June 10, 2005 it should be in the document itself. I have never seen one that says a person can't stop deferring. (Changing to a different amount is different, but stopping deferrals should be possible at anytime.)
wmyer Posted June 10, 2005 Posted June 10, 2005 I believe the answer is that generally elections must be permitted at least annually. In the case of a SIMPLE, the participants must be permitted to revoke their elections at any time. W Myer
