Guest Iwonder
Is a grandfathered governmental 401(k) plan subject to the Sarbanes-Oxley rules regarding blackout notices? I continued to research and found the answer, which was found in a footnote (Footnote 28) to the Senate Finance Committee report on NESTEG, 109-174, dated 11/2/05: "Governmental plans and church plans are exempt from ERISA. Accordingly, the blackout notice requirement does not apply to these plans."
