Guest RJF Posted February 27, 2006 Posted February 27, 2006 Under final 401(k) regs, does this still work? SH QMAC is 100% on the first 4% - Not subject to vesting, no hours or employment status Discretionary Match = 50% of deferrals up to 6% of comp. - Subject to Vesting, 1000 hrs. and last day Is any of this subject to adp testing? Is any of this subject to acp testing?
Archimage Posted February 27, 2006 Posted February 27, 2006 Your discretionary match cannot have allocation requirements under the final regs.
Guest RJF Posted February 27, 2006 Posted February 27, 2006 Starting 2006 I hope.? Also, if they do keep the allocation requirement, doesn't that mean its just subject to acp test?
Archimage Posted February 28, 2006 Posted February 28, 2006 That is right, starting for plan years that begin in 2006.
Guest RJF Posted March 1, 2006 Posted March 1, 2006 Any thoughts on how our documents will reflect this new change? Is there guidance on when we need to have amendments etc. Right now the document allows for this as a discretionary contribution subject to allocation requirements.
