blue Posted March 22, 2006 Posted March 22, 2006 Expected changes to EPCRS Revenue Procedure 2003-44 included correcting the problem of excluding eligible employees from making deferrals. The expected change required a make up contribution of only 50% of the ADP for the employee’s category. Does anyone know if you can rely on the proposed change before it is finalized?
namealreadyinuse Posted March 22, 2006 Posted March 22, 2006 Yes, the IRS is processing applications under the new system. Remember that the match is still on 100% of the ADP though (kind of tricky).
blue Posted March 23, 2006 Author Posted March 23, 2006 Do you know when the changes will be finalized. Also, is there written guidance stating reliance on the proposed changes is okay.
namealreadyinuse Posted March 23, 2006 Posted March 23, 2006 No and probably not. The IRS is using the new procedures in procesing all applications, so call them if you want.
