Guest Ted Kowalchuk, CFP, CFS, Posted January 8, 2007 Posted January 8, 2007 Can a church establish a 401(k) plan?
Jim Chad Posted January 9, 2007 Posted January 9, 2007 Yes, since SBJPA. After 1996 tax exempt organizations have been able to have 401(k) Plans.
Fisher Posted January 9, 2007 Posted January 9, 2007 Not sure why they would want a 401k versus a 403b. If they are a 3121(w)(3) church organization, there would be no discrimination testing required in a 403b Pension program while if establish a 401k they would be subject to ADP, ACP, 401(a)(4) etc.
