Bruddah Kimo Posted January 9, 2008 Posted January 9, 2008 Hi - In a calendar plan year 401k plan, if a participant ceases to make loan repayments in July 2007 and the loan is deemed at the end of the cure period, what is the correct date for the distribution of the 1099-R? The end of the calendar quarter would be 12/31/2007 - is the loan deemed as of 12/31/2007 necessitating a 2007 1099 or is it the first day following the end of the quarter, 1/1/2008, necessitating a 2008 1099? Mahalo!
masteff Posted January 9, 2008 Posted January 9, 2008 The example to Q&A-10 of reg 1.79(p)-1 indicates it would a deemed distribution on 12/31 (the last day of the quarter). So for your case it would be a 2007 1099. Kurt Vonnegut: 'To be is to do'-Socrates 'To do is to be'-Jean-Paul Sartre 'Do be do be do'-Frank Sinatra
