alexa Posted May 2, 2009 Posted May 2, 2009 Hi All, I have a 401(k) plan with immediate eligiiblity for 401(k) and match If we don't to allow a refund after 90 days to folks automatically enrolled, how would that work with the 30-day notice requirement in aplna with immediate plan elgiiblity at date of hire? Lexy
PensionPro Posted May 2, 2009 Posted May 2, 2009 Under the final regs the notice would be considered timely as long as it is provided prior to the first pay date and the employee has reasonable time make an election. PensionPro, CPC, TGPC

Say we give the new hire 30 days to "opt out" and the 1st auto contribution goes in right after the 30 days , can we as employer elect not to allow for distributions in the 1st 90 days undre the final reg?
PensionPro Posted May 3, 2009 Posted May 3, 2009 The 90 day withdrawal provision is optional in an EACA/QACA, not a required provision. PensionPro, CPC, TGPC
