Guest rim Posted August 11, 1999 Posted August 11, 1999 Is spousal consent required for a hardship distribution from a 401(k) plan?
MoJo Posted August 11, 1999 Posted August 11, 1999 If the plan is subject to the spousal consent requirements, then yes....
EGB Posted August 11, 1999 Posted August 11, 1999 As an addition to MoJo's comment, the plan will have spousal consent requirements if it contains joint and survivor annuities. If the plan contains only lump sums and/or installments, spousal consent should not be needed unless the plan specifically contains such a requirement.
Guest pstowers Posted August 11, 1999 Posted August 11, 1999 This doesn't pertain just to hardship withdrawals, but if the plan has lump sum as default distribution and options of J&S or installments, is a spousal consent form needed for a)hardship loan or withdrawal and b)Distribution at termination?
