Guest russella0829 Posted December 23, 2009 Posted December 23, 2009 I have inherited the administration of a 401k plan that apparently has never suspended employee contributions after hardship withdrawals have been taken (going back to 1994). Was this ever legal? What is the correction method for this? Thank you,
QDROphile Posted December 23, 2009 Posted December 23, 2009 Maybe the plan did not use the safe harbor and the suspensions were not required. Get out of the business if you did not consider this possibility. Apologies if you did.
