Guest Pension Girl Posted February 25, 2010 Posted February 25, 2010 If a plan includes all employees, and then later wants to exclude a class, say per diem, is there any problem? Plan can be amended, but since eligibility and job class is not a protected benefit I do not see a problem?
Guest Sieve Posted February 25, 2010 Posted February 25, 2010 No problem that I see, as long as the exclusions are otherwise valid--i.e., not excluding hour-based (such as part-time) employees, and not excluding anyone based on membership in a protected category.
