The employees must be notified at least one month in advance of the plan's effective date. Where can I find what the notice must contain? 2. Can the first plan year for a Safe Harbor 401(k) Plan be less than 12 months? 3. Can a Safe Harbor 401(k) Plan have a non-calendar plan year that is (a) the same as the corporation's fiscal year, or (B) different from the corporation's fiscal year. 4. What IRS notices, rulings, regulations etc. contain information on these plans? Thanks
Guest Posted November 15, 1999 Posted November 15, 1999 1. if safe harbor formula is matching or non-elective contribution 2.any other contributions that might be made to the plan, and eligibility conditions for them 3.which plan will receive the safe harbor (you could make it to a money purchase 4.definition of compensation 5.deferral election periods 6.withdrawal and vesting conditions for contributions first year can be short, but at least 3 months plan year , not calendar year notice 98-52 (click) [This message has been edited by Dave Baker (edited 11-15-1999).]
