Nassau Posted August 18, 2010 Posted August 18, 2010 Participant would like to reinstate back into the ABC Plan. When participant rolled out of the Plan, all of his money was traditional pre-tax; however, when he rolled it to the IRA, it was converted to Roth. Since the Plan does allow Roth rollovers, is it permissible to allow the money to be restored as Roth?
Mike Preston Posted August 18, 2010 Posted August 18, 2010 My EGTRRA Volume Submitter 401(k) plan allows Roth rollovers into the plan. I wouldn't normally elect that option if the plan doesn't otherwise allow Roth accounts. What does your plan say?
rcline46 Posted August 19, 2010 Posted August 19, 2010 I think there is still a prohibition of rolling Roth IRA money into a qualified plan. THe only Roth rollovers permitted are from another qualified plan or 403(b). I think the participant is 'SOL' unless they use other assets.
401king Posted August 19, 2010 Posted August 19, 2010 rcline is correct. Here is the IRS's rollover chart which indicates that Roth IRA's are not eligible to be rolled into a 401k account - http://www.irs.gov/pub/irs-tege/rollover_chart.pdf R. Alexander
