Guest elang
Plan has partial Plan Termination in 12/2010. All affected participants become 100% vested. Question I had was whether or not a participant that was terminated in 2006 but still has an account balance needs to be become 100% vested? Thanks
John Feldt ERPA CPC QPA
Only affected participants become 100% vested. It is unlikely that a terminee from 2006 was part of the affected group or affected by this partial termination. Employees who left voluntarily in 2010 might or might not be considered as 100% vested, depending on the circumstances. Anyone who stayed around, of course, they would not be 100% vested. (perhaps that is ironic?) edited: typo
frizzyguy
Personally, we don't 100% vested terms upon plan termination but I do know that this an issue that others will disagree on and if the plan document is gray on the issue, you might want to ask the employer what they want to do. david rigby
Personally, we don't 100% vested terms upon plan termination ... First: significant difference between a "partial plan termination" and a "plan termination". To which do you refer? Second: depends who is "we". It's not up to the TPA to make the decision.
