30Rock Posted August 25, 2011 Posted August 25, 2011 I have a plan that is considering using the QSLOB rule. However, I am struggling with the gateway test which requires coverage testing on an employer wide basis. With this test being necessary, how will QSLOB testing help my plan pass coverage, if I still have to pass this gateway? My plan fails ratio % and average benefits test - both parts. Thanks!
ETA Consulting LLC Posted August 25, 2011 Posted August 25, 2011 If it is a QSLOB, fully tested to meet the QSLOB requirements each year, then it is not even treated as the same employer for compliance testing purposes. You have to ensure it meeting the strict requirements of a QSLOB (shooting from the hip, but I believe there's a 50 employee minimum). Good Luck! CPC, QPA, QKA, TGPC, ERPA
ESOP Guy Posted August 25, 2011 Posted August 25, 2011 Below is 100% of what I know about QSLOBs. 1) I say this alot but it is a subject it is worth to hire an expert. The cost of getting it wrong is too high. 2) But if you wish to keep looking I beleive the part you are missing is that the Gateway has a Safe and Unsafe Harbor number. I have no idea if these are the same as the ABT safe harbor/unsafe harbor numbers.
