Guest erisalady Posted October 9, 2012 Posted October 9, 2012 if a daughter in-law works for her husbands parents and they are 100 pct owners of a company...does that make her a key employee?
ETA Consulting LLC Posted October 9, 2012 Posted October 9, 2012 No. There is no double attribution of ownership under IRC Section 318. So, no attribution to in-laws. Good Luck! CPC, QPA, QKA, TGPC, ERPA
John Feldt ERPA CPC QPA Posted October 9, 2012 Posted October 9, 2012 I'm sure you know, but keep in mind that she does not have to have any ownership to be key IF she is an officer (or has executive authority) and is being paid wages over the 416(i)(1)(A)(i) threshold ($160,000 for 2012).
