Guest ghal Posted November 9, 2012 Posted November 9, 2012 Is a multiple employer 401k plan eligible to maintain a pre approved plan doc? Or are they required to maintain an individually drafted document? The document provider is asking our client to complete a Form 8717 and Form 5300 to request a determination letter. Is this necessary or can we adopt a pre approved plan? The current doc is individually drafted and has been for many years. If we can avoid it then we should. There are no provisions in the current doc that a pre approved plan would not allow. It is just the multiple employer issue (not an open mep, these are two related employers). Thanks CPC, ERPA
John Feldt ERPA CPC QPA Posted November 9, 2012 Posted November 9, 2012 Many pre-approved volume submitter defined contribution plan documents currently allow multiple employer provisions. In 2014 when the next restatement window opens, prototypes will also be allowed to have multiple employer provisions instead of just the vol/ sub. documents. If you are sure that the reason for the IDP document is not because of some other provision(s) in the plan, then you should be able to find an EGTRRA pre-approved vol. sub, document to accomodate.
