Employer wants to adopt a retirement plan but does not want the plan name to include the name of the sponsoring busines. He wants such inconspicous name as "RMZ Pension Plan"

As long as the employer EIN is correct in the filing, is there anything that forbids the plan sponsor to name the plan without including the sponor's business name?

Well, not anything you want. You probably can't name it the IBM Pension Plan. :)

Just don't pick something that could be confusing.

If you search for Forms 5500 at DOL.gov, you will see a fair number of plans called "The 401K Plan" "The 401(k) Plan" "401(k) Plan" and "401K Plan" so it is not unheard of to have plan names that don't repeat the plan sponsor's name.

Review of a domestic relations order might be interesting under those circumstances. Which plan does the order "clearly specify"?

If the participant is in more than one, it could read:

50% of the ABC Company Profit Sharing Plan, and

50% of "The 401(k) Plan" sponsored by D.E.F., LLC

QKA, QPA, CPC, ERPA
