Guest A_Dude Posted January 9, 2013 Posted January 9, 2013 This seems to be a stupid question, but I need a quick answer and cannopt find it. A husband and wife own an S Corp. They employ a housekeeper, but not as an "employee". If they put in a plan, do they need to cover her? Quick thoughts are QSLOB and non-related service to the company.
KJohnson Posted January 9, 2013 Posted January 9, 2013 I assume she doesn't do any work for the S Corp. If she works at their house I don't think she would be employed by a trade or business so the controlled group/comon control rules would not come in to require to be be included in any coverage testing. Look here.... http://benefitslink.com/modperl/qa.cgi?db=qa_who_is_employer&n=129 BTW you need 50 employees for a QSLOB
K2retire Posted January 9, 2013 Posted January 9, 2013 Do they report her income on a 1099 or a W-2? ETA Consulting LLC 1
Guest A_Dude Posted January 14, 2013 Posted January 14, 2013 Not sure how they report the housekeepers income. Thanks KJohnson for the link; I think that gives me a pretty good base to go off of. And, thanks for reminding that I was using QSLOB incorrectly. Cheers~!
