Guest Hgreer Posted January 30, 2013 Posted January 30, 2013 Had a participant pass away and his wife came up from Columbia. She is not a US citizen and does not have a SSN. He had two grown sons who do have SSNs. Does this have to be resolved in probates since there is no beneficiary form or will? Thanks for the response.

masteff Posted January 30, 2013 Posted January 30, 2013 Assuming, as ETK questions, your plan says the default beneficiary is the surviving spouse, you'll want to review form W-8BEN. I think but am not positive that form will require that she get a TIN (tax id number).
