QDROphile Posted June 23, 2014 Posted June 23, 2014 It depends on the legal status of the employer. A government or governmental instrumentality cannot adopt a 401(k) plan. It may be possible to get into a grandfathered governmental 401(k). Determining status of a governmental instumentality can be difficult.
MoJo Posted June 23, 2014 Posted June 23, 2014 In my experience, charter schools are either not-for-profit entities, or for-profit entities - and NOT governmental entities. As, yes, they can have a 401(k) plan. If a non-profit, they could have a 403(b) plan or a 401(k) plan.
