Pension RC Posted July 13, 2016 Posted July 13, 2016 I am working on a plan that requires 1950 hours for a year of credited service. I thought that it couldn't exceed 1000 hours. Can it? Can someone point me to the right section of the IRC? Thanks for any responses!

Recollection, however, is can require more than 1,000 hours for full-credit but must grant partial credit if greater than 1,000 hours. This I believe was described in an DOL reg. 2530-200b. If so, 29 C.F.R. 2530.204-2 shows examples of how a plan may require 2,000 hours of accrual service for a full year of participation. david rigby Posted July 13, 2016 Posted July 13, 2016 IRC 410(a)(3)(A). Note that this IRC section is the definition of "participating service", not accrual (or benefit) service. I'm a retirement actuary. Nothing about my comments is intended or should be construed as investment, tax, legal or accounting advice. Occasionally, but not all the time, it might be reasonable to interpret my comments as actuarial or consulting advice.
My 2 cents Posted July 13, 2016 Posted July 13, 2016 Can condition accrual of a full year of benefit accrual service on more than 1,000 hours in a year, but not vesting service. Always check with your actuary first!
