thepensionmaven Posted May 24, 2017 Posted May 24, 2017 Employer sponsors stand alone safe harbor non-elective, can the plan be amended to safe harbor match the folowing year, assuming all notices are timely given?
Tom Poje Posted May 24, 2017 Posted May 24, 2017 yes, there is no requirement a plan be locked into one safe harbor formula forever, only for a given year.
thepensionmaven Posted May 24, 2017 Author Posted May 24, 2017 Assume you mean, one year at a time? If the client amends the plan to do the safe harbor match with a "maybe" notice for all future years?
ETA Consulting LLC Posted May 24, 2017 Posted May 24, 2017 There is no "maybe" for match. Only "SHNEC". Good Luck! CPC, QPA, QKA, TGPC, ERPA
Belgarath Posted May 24, 2017 Posted May 24, 2017 Perhaps I'm misunderstanding what you are saying, but you can't use the "maybe" notice for a safe harbor matching provision - only for a nonelective. Looks like ETA and I were responding at the same time, but I type more slowly...
