401(k)athryn Posted December 13, 2019 Posted December 13, 2019 Can a non-electing church plan require that only full-time employees are eligible for all contributions, even if that means that some employees working more than 1,000 hours are EXCLUDED? It seems permissible, but I just want to be sure...Also, I am seeing some old coverage rules that may indicate that they need to cover 70% of their total # of employees? Is that applicable? Thanks!
Patricia Neal Jensen Posted July 9, 2020 Posted July 9, 2020 A Non-Electing Church plan is not ERISA. Eligibility such as you mention is fine. Some of these plans cover only ordained clergy.
