Hi, 

The plan termination date is 10/07/2022, and all contribution has been completed.  Since this is a safe harbor plan will a safe harbor notice needs to be sent to the participants?  The 30 days notice.

Do you mean a safe harbor notice for 2023? Wouldn't that be somewhat misleading (or short)?

I'm assuming this is a calendar year plan. Did you meet one of the exceptions to continue to be treated as a safe harbor plan in the year of termination since it is less than 12 months?

Thank you! Since the notice was not sent the counsel has advised to proceed with one last contribution.

Yes, the counsel has advised to do the last contribution.
