Tom Posted August 21, 2024 Posted August 21, 2024 Participant has passed and spouse passed some years ago. We believe 3 adult children are beneficiaries. Question - I imagine the beneficiaries will need to waive the annuity as the default distribution option just as the participant would if he had lived and elected to roll to an IRA? Thank you
Lou S. Posted August 21, 2024 Posted August 21, 2024 What does the Plan Document say about distributions to non-spouse beneficiaries and their options? acm_acm, Luke Bailey and CuseFan 3
acm_acm Posted August 27, 2024 Posted August 27, 2024 Like Lou said, you have to follow the plan document. Don’t assume anything. If there’s any ambiguity, the client needs to make the call (in writing to CYA) on how to proceed and should consider getting an ERISA attorney’s advice on the matter.
