Disagreement in our office about when the Cares Act and Secure Act amendments must be done. One person saying 12/31/25 and another saying 12/31/26.

The IRS in a Sept. 12 edition of Employee Plans News focuses on plan amendment deadlines that were extended by the “Grab Bag” guidance the IRS issued in Notice 2024-02 on Dec. 20, 2023 and Revenue Procedure 2022-40 on Nov. 21, 2022.

In that notice, the IRS extended and consolidated the deadlines for a retirement plan in accordance with major legislation enacted in the last five years, including the SECURE Act of 2019, the CARES Act, the Taxpayer Certainty and Disaster Tax Relief Act of 2021, and the SECURE 2.0 Act.

The plan amendments deadlines the IRS highlights in the Sept. 12 update include the following.

Dec. 31, 2026

  • qualified plans that are not a governmental plan or an applicable collectively bargained plan
  • 403(b) plans that not maintained by a public school
