KIP KRAUS Posted January 24, 2001 Posted January 24, 2001 Jean: That doesn't make sense to me. If you were actively at work on the day you were fired your coverage should end on that date. Check with the insurer. Did the employer offer you COBRA?
Guest Jean Allen Posted January 24, 2001 Posted January 24, 2001 Kip, On January 2, 2001 he went into work, was called into HR and was terminated and told to leave immediately. Upon further discussion and paperwork over a week later, he was told that they canceled his health insurance on December 29, 2000. "just the way we do it". I have heard this was is against ERISA. I am just trying to find something in writing so he can proceed. Yes, COBRA was offered several weeks after the termination.
KIP KRAUS Posted January 29, 2001 Posted January 29, 2001 If you have an insured medical plan I'd check with the state Insurance Commission as to the legality of canceling coverage retroact. My guess is that it is illegal.
