That doesn't make sense to me. If you were actively at work on the day you were fired your coverage should end on that date. Check with the insurer.

On January 2, 2001 he went into work, was called into HR and was terminated and told to leave immediately. Upon further discussion and paperwork over a week later, he was told that they canceled his health insurance on December 29, 2000. "just the way we do it". I have heard this was is against ERISA. I am just trying to find something in writing so he can proceed.

Yes, COBRA was offered several weeks after the termination.

If you have an insured medical plan I'd check with the state Insurance Commission as to the legality of canceling coverage retroact. My guess is that it is illegal.
