Guest BARBARA CAIRNS Posted April 4, 2001 Posted April 4, 2001 I was laid off by a government contractor whose COBRA I picked up. After making 3 premium payments, I was told the contractor terminated the plan and my last premium would be returned to me. The successor contractor did not pick me up and denies any responsibility for my COBRA. Although the former companiy still exists I cannot find out if they still have a contract with the same insurance company. Who is responsible for continuing my COBRA? I am a cancer patient and need the medical coverage.
Guest lmrice Posted April 5, 2001 Posted April 5, 2001 If the previous employer cancelled the group coverage and transferred to a new carrier, I believe you should be eligible under that new carrier. COBRA participants have the same rights as active employees when it comes to coverage. If you can't get an answer from your previous employer, I would definitely get an attorney. Best of luck. Guest BARBARA CAIRNS Posted April 5, 2001 Posted April 5, 2001 After threatening to have this matter investigated, the successor company has suddenly acknowledged they are responsible to absorb my COBRA under the Federal Service Contract Act. Of course, when they actually do enroll me is another question, that is if they are not stalling me. Because when first asked, they denied any responsibility. I know who their insurance company is, and although they have told me I should have a benefits package by the end of next week, I will continue to call the insurance company until my name and the other employee's names have been submitted for coverage. If I have to spend the time getting an attorney, my window for treatment may pass. Thanks for your help..........
