Emerging Theories of Liability in ERISA Litigation and Lessons Learned for Plan Fiduciaries

Trucker Huss

Mar. 23, 2021
On-Demand
Webinar

PRESENTERS:  Clarissa Kang, Dylan Rudolph, and Catherine Reagan

This webinar will provide an overview and insight on a new wave of claims by participants (brought individually, or on behalf of a class or even the plan itself) against plan fiduciaries and/or plan service providers.  The focus of this presentation will be on claims related to the use of participant data as a plan asset, cyberbreaches, and alleged failures to protect participant information and plan assets from fraudulent activity.

The panel will discuss the impact of this litigation, the trends, and what this means for plan fiduciaries.  We look forward to sharing tips on how plan fiduciaries can monitor plan service providers and structure service provider agreements to guard against these claims going forward and/or to best position themselves in a potential lawsuit.
