There has been an increasing debate over the past few years on the topic of environmental, social and governance (ESG) investing in ERISA-covered retirement plans. Some practitioners, under the banner of “ESG integration,” believe that ERISA fiduciaries should be required to consider ESG factors in their investment decisions. But others think that ERISA prohibits the consideration of ESG factors by fiduciaries unless they are financially material to the investment in question.
